A LAUTOKA man who was jailed in December last year for whipping his 10-year-old son with an extension cord has been set free.

Sakaraia Dakai was initially sentenced to two years imprisonment with a non-parole period of 18 months by the High Court in Lautoka after being found guilty of unlawful wounding.

He appealed the sentence and after spending three months in prison, he was released last week.

Justice Sudharshana De Silva said taking into account the background of the case, he exercised his power under the Criminal Procedure Decree to quash the initial sentence.

Justice De Silva removed one year from Dakai's two-year sentence, deducted six months for mitigating factors and removed another six months for the 36-year-old father of three's guilty plea.

He acknowledged Dakai's three month prison term and suspended the remaining nine months for three years.

Justice De Silva said the initial magistrate had correctly issued a permanent Domestic Violence Restraining Order with non-molestation conditions.
